I do think that such a thing could present the possibility of a class action. Many individual states (not to mention jurisdictions outside of the US) have fraudulent trade practices laws that allow for civil suits, and it wouldn’t be surprising if a law firm filed a class action lawsuit over this.

But whether such a claim is even accepted depends, among other things, on the amount that is achieved by the surcharge of 10 euros. For example, if we assume that with the sale of 20 million units it will be possible to earn about 200 million euros more, one must first check whether this amount is enough.

After all, Sony has since added information to the PS4 version that it includes a free upgrade to the PS5 version. But that fact alone is not enough to keep consumers from buying the more expensive version of the PS5.
